1. Agreement to Terms

These Terms of Service constitute a legally binding agreement between you (“Client”) and Yad Al Ma Landscape & Gardening LLC (“Company”), a corporate entity duly licensed under the commercial laws of the United Arab Emirates. By accessing yadalma.com (including yad.ae) or commissioning any architectural design, softscaping, hardscaping, civil execution, or Annual Maintenance Contract (AMC), you accept and agree to be bound by these provisions.

2. Proposals, Quotations & Work Orders

All preliminary project estimates, 3D architectural renders, and written proposals are valid for 30 calendar days from issuance. Formal project commencement requires a signed Scope of Work (SOW) agreement and the settlement of the specified mobilization advance payment.

• Design Rights: Conceptual 2D/3D design schematics remain the intellectual property of Yad Al Ma until the contract is executed in full.
• Site Access: The Client must provide unobstructed access to the premises, adequate water supply (DEWA/FEWA connection), and temporary electricity during construction phases.
• Permitting & Approvals: While Yad Al Ma assists in securing municipal approvals (Dubai Municipality, Trakhees, Nakheel, Emaar), final issuance is subject to the respective authority's regulatory discretion.

3. Annual Maintenance Contracts (AMC)

AMC packages (Essential, Signature, Royal Estate) are contracted on an annual basis with fees payable monthly or quarterly in advance.

• Scheduling: Maintenance visits occur on fixed designated weekdays. In cases of adverse meteorological conditions (sandstorms, extreme heat waves exceeding official safety directives), visits may be rescheduled within 48 hours.
• Exclusions: Acts of God, force majeure, vandalism, severe municipal water supply disruption, or unauthorized client chemical applications are excluded from standard warranty coverage.
• Contract Cancellation: AMC agreements may be terminated by either party upon 30 days prior written notice to info@yad.ae.

4. Plant Warranty & Workmanship Guarantee

Yad Al Ma warrants all newly planted trees, palms, and shrubs against mortality for 90 calendar days post-installation, provided that an active Yad Al Ma maintenance service or verified automated irrigation schedule is maintained.

Structural hardscaping, pergolas, paving stones, and water feature pumps carry a 12-month limited warranty covering material defects and workmanship.

5. Payment Terms & Late Settlements

Invoices are payable within 14 calendar days of issuance via bank wire transfer, corporate cheque, or authorized payment gateway. Delayed settlements past 30 days may incur suspension of ongoing maintenance services until arrears are cleared.

6. Governing Law & Dispute Resolution

These terms and any non-contractual obligations arising out of them are governed by and construed in accordance with the Federal Laws of the United Arab Emirates and the local regulations of the Emirate of Dubai. Any dispute shall be referred to the exclusive jurisdiction of the competent Dubai Courts.
